Access to and use of the Website are subject to these Terms and Conditions (“Terms”). By accessing the Website, you agree to be bound by these Terms. If you do not agree, you must stop using the Website.
2. Intellectual Property
All content available on the Website, including text, graphics, photographs, images, logos, software, code, design elements, videos, and other materials (“Content”), is owned by or licensed to Flâneur and is protected by applicable intellectual property laws.
You may access the Content for personal, non-commercial use only. No Content may be reproduced, copied, modified, distributed, displayed, or otherwise exploited for commercial or public purposes without our prior written consent.
3. Acceptable Use
You agree not to use the Website in any unlawful manner or in a way that disrupts, damages, or impairs its functioning. This includes, without limitation, attempting to access restricted areas, scraping or mining data without authorization, introducing malware, or using automated systems without permission.
We may take technical, contractual, or legal action in response to misuse of the Website.

To the fullest extent permitted by applicable law, Flâneur shall not be liable for any indirect, incidental, punitive, or consequential damages arising from the use of or inability to use the Website.
This includes, without limitation, damages arising from system failures, inaccuracies, interruptions, or the purchase of products from unauthorized resellers. Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, or death or personal injury caused by negligence where such limitation is prohibited by law.

The Website may contain links to third-party websites. Flâneur does not endorse or control these websites and is not responsible for their content, privacy practices, or security.
Access to third-party websites is at your own risk.
7. Modifications to These Terms
Flâneur reserves the right to modify these Terms at any time. The updated version will be posted on the Website with a revised effective date. Continued use of the Website after changes are posted means you accept the updated Terms, to the extent permitted by law.
8. FLÂNEUR+ Loyalty Program Terms
8.1 Overview and Eligibility
The FLÂNEUR+ loyalty program (“Program”) is operated by Flâneur and is available to individuals aged 16 or older. Participation is free and limited to one account per person.
Business users, resellers, and distributors are not eligible. Participation in the Program constitutes acceptance of these Program terms.
8.2 Qualifying Purchases
Only purchases made directly through Flâneur’s official sales channels, the Website (www.flaneur.eu) and the Flâneur boutique in Amsterdam, qualify for earning Flâneur Coins (“FLC”) and for counting toward tier progression.
Purchases made at third-party retailers, department stores, resellers, marketplaces, or any external partners, even if the products are authentic Flâneur items, do not qualify. Verification of boutique purchases may require a valid receipt.
8.3 Earning Flâneur Coins (FLC)
Members earn FLC, a non-monetary rewards currency, at the rate of 10 FLC per EUR 1 spent, unless otherwise indicated for selected items or promotions. Additional earning activities may be available within the member’s loyalty account.
Eligible historical purchases may be credited when associated with the same email address. Boutique purchases without an email record may be added after submission of a valid receipt.
FLC have no monetary value, cannot be redeemed for cash, and may only be used within the Program, subject to these Terms.
8.4 Redeeming FLC
Members may redeem FLC for discounts when shopping online or at the boutique. Redemption values are set by Flâneur and may change from time to time.
If a purchase made with FLC is returned, the monetary portion will be refunded to the original payment method and the redeemed FLC will be reinstated to the member’s account, subject to applicable return conditions.
8.5 Tier Structure
The Program includes three tiers: Tourist, Explorer, and Local. Tier status is based on the member’s net eligible spend during a rolling 12-month period.
“Net eligible spend” means the total amount spent after deducting refunds, cancellations, chargebacks, and adjustments.
Tier benefits apply from the date a member enters a tier and remain active for 12 months, unless adjusted under these Terms.
8.6 Tier Downgrades and Adjustments
If returns or adjustments reduce a member’s net eligible spend below the threshold required for their current tier, Flâneur may adjust the member to the appropriate tier.
For example, if a member qualifies for the Local tier by spending EUR 1,000 and later returns EUR 600, reducing net spend to EUR 400, the member’s tier may be adjusted accordingly.
Tier allocations may be processed and displayed in the account up to 21 days after the qualifying purchase has been made.
8.7 Coins and Account Inactivity
FLC do not expire. Flâneur may close accounts that remain inactive for 24 months. Members may request reactivation and reinstatement of any valid FLC, unless restricted by law.
8.8 FLÂNEUR+ Wallet Card
Members may add a digital FLÂNEUR+ Card to their mobile wallet. The card may support earning FLC, redeeming rewards, viewing tier status, and accessing exclusive benefits.
8.9 Fraud, Misuse, and Termination
Flâneur may suspend or terminate a loyalty account, revoke FLC, downgrade tier status, or deny benefits if misuse or fraud is suspected.
This includes, without limitation, creating duplicate accounts, manipulating FLC earning systems, submitting fraudulent receipts, abusing promotions, or engaging in reseller behaviour.
8.10 Program Modifications
Flâneur reserves the right to modify, limit, or terminate any aspect of the Program at any time, including earning rates, redemption values, tier thresholds, rewards, benefits, eligibility rules, and participating channels, with or without notice, to the extent permitted by law.
Continued participation constitutes acceptance of any modifications.
9. Terms of Sale
9.1 Scope
These Terms of Sale apply to purchases made through the Website by consumers. By placing an order, you agree to these Terms of Sale.
Purchases made in the FLÂNEUR boutique in Amsterdam are subject to the applicable in-store conditions.

9.3 Ordering and contract formation
An order placed through the Website constitutes an offer by the customer to purchase the selected products. A contract is concluded only when Flâneur confirms the order by email.
Flâneur may refuse or cancel an order where there is suspected fraud, a pricing or product-description error, or product unavailability. If Flâneur cancels an order after payment has been made, any amount paid will be refunded in full.
9.4 Prices and payment
All prices shown on the Website include VAT where applicable, unless stated otherwise. Prices do not include shipping costs or, for deliveries outside the European Union, import duties, customs charges, or local taxes, unless expressly stated otherwise at checkout.
The total amount payable, including shipping costs, is displayed before the order is placed.
9.5 Shipping and delivery
Shipping costs depend on the destination and the order value. The applicable shipping costs, free-shipping thresholds, and delivery methods are shown on the Website and at checkout.
Delivery times are estimates only and are not guaranteed unless expressly stated otherwise. Orders placed before 16:00 Amsterdam time are, where possible, dispatched the same business day.
9.6 Import duties, customs charges, and refused parcels
For deliveries outside the European Union, import duties, customs charges, and local taxes may apply and are the customer’s responsibility unless expressly stated otherwise at checkout.
The customer is responsible for checking whether such charges apply before placing an order. Where a parcel is refused or returned to sender because the customer did not pay applicable duties, customs charges, or local taxes, Flâneur may deduct reasonable, documented return-related costs actually incurred in connection with the refusal or return, to the extent permitted by applicable law.
If you are a consumer in the European Union, you have the right to withdraw from the purchase within 14 days without giving any reason.
The withdrawal period begins on the day you, or a third party designated by you other than the carrier, receive the goods. To exercise your right of withdrawal, you must inform Flâneur of your decision to withdraw by using the Returns Center at flaneur.returnista.com, by email at support@flaneur.eu, or by using the model withdrawal form.
You must send back the goods without undue delay and in any event within 14 days after notifying Flâneur of your withdrawal. The goods should be returned in their original, unused, unaltered, and unwashed condition, with original tags and packaging, to the extent reasonably possible.
UK Consumers
If you are a consumer in the United Kingdom and place an order through the Website, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 may apply. Where applicable, you have the right to cancel your order within 14 days in accordance with those regulations.
Before you place your order, we will provide the information required by applicable UK law, including the identity of the trader, the main characteristics of the products, total price, delivery charges, and cancellation rights. Where a right to cancel applies, we will make the model cancellation form available to you. You may use the model form, but you are not required to do so.
If you cancel a qualifying UK order, we will refund payments received in accordance with applicable UK law, including standard outbound delivery costs where required.
US and Canada Consumers
If you place an order from the United States or Canada, your purchase may be subject to mandatory consumer protection laws in your jurisdiction. Nothing in these Terms limits any non-waivable rights you may have under applicable local law.
Where local law requires specific disclosures, cancellation rights, refund timing, taxes, duties, or return-policy language, those rules will apply in addition to these Terms. If there is any conflict, the mandatory rules of the consumer’s jurisdiction prevail.
9.8 Effects of withdrawal and refunds
If you withdraw only from part of the order, Flâneur will refund the price of the returned products and, where required by law, any proportionate outbound shipping costs attributable to the returned items.
Refunds will be made without undue delay and in any event no later than 14 days after we are informed of your withdrawal. We may withhold the refund until we have received the returned goods or proof that they have been sent back, whichever comes first.
Refunds will be made using the same means of payment used for the original transaction, unless you expressly agree otherwise. The direct cost of returning the goods is borne by you.
9.9 Diminished value
The customer is liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning.
9.10 Conformity and complaints
Flâneur delivers products that conform to the contract in accordance with applicable Dutch and EU consumer law. Complaints about defects or non-conforming deliveries can be submitted to support@flaneur.eu.
Statutory warranty rights are not affected by these Terms.
9.11 Applicable law and disputes
These Terms of Sale are governed by Dutch law, without prejudice to mandatory consumer protections of the customer’s country of residence.
